2. The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No.28 of 2024, for the alleged offences registered under Sections 379, 411, 419, 420 and 34 of Indian Penal Code, Section 21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned A.C.J.M., Palamau at Daltonganj.

Learned counsel appearing for the petitioner submits that three tractors have been seized loaded with 100 cft. sand. He further submits that the allegations are made that this petitioner has signed the challan of the sand which was forged on. He then submits that the petitioner has not signed the said challan and the petitioner happened to be President of Samiti formed to look into the mining activity. He next submits that the

said challan was valid till 9th June, 2024 and based on the said challan the sand was carried on 10th June, 2024. He also submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.17 of the petition.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioner of transporting the sand on invalid challan.

Considering that the challan was there, however, that was valid up to 09.06.2024 and the dispute is there with regard to the said challan and the petitioner has got no criminal antecedent as disclosed in paragraph No.17 of the petition, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Palamau at Daltonganj in connection with Ramgarh P.S. Case No.28 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
