This Writ Petition has been filed against the order dated 26.05.2025 (Annexure P/6) whereby Sub-Divisional Officer (Revenue), Bemetara District Bemetara has ordered for suspension of fair price shop allotted to the petitioner located at Piparbhatta, Bemetara (ID No.432009015). Learned counsel for the petitioner submits that show cause notice issued to the petitioner in respect of the Fair Price shop by the Respondent No. 4 is without giving any opportunity of hearing to the petitioner as prior to issuance of show cause notice to the petitioner, fair price shop allotted to the petitioner has been suspended on 26.05.2025 and show cause notice was issued on 30.05.2025. Without issuing any show cause notice, only on the basis of spot inspection, the impugned orders have been passed. 3. Learned counsel the petitioner further submits that concerned SDO (Revenue) has already initiated proceedings under Chhattisgarh Public Distribution System (Control) Order, 2016 and the petitioner has also caused his appearance in the said proceedings. As such, the concerned SDO (Revenue) may be directed to expedite the said proceedings and the petitioner may be permitted to raise all his grievance in this respect in the proceedings before the SDO. 4. Considering the limited prayer of the petitioner and since the proceedings under Control Order, 2016 are already underway before the SDO, this Court deems it appropriate to dispose of this petition directing the SDO (R) concerned to proceed in the matter in an expedite manner and pass appropriate orders after giving due opportunity of hearing to the petitioner, in accordance with law.
