GP FOR REVENUE The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- <…to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of Respondents Nos 3 and 4 in not registering the FIR against the respondents 5 to lion the basis of the petitioners complaints dated 06122025 and 15122025 is illegal arbitrary and contrary to law and consequently to direct Respondent Nos 3 and 4 to forthwith register FIR on the basis of the petitioners complaints dated 06 122025 and 15122025 and to conduct fair impartial and timebound investigation against Respondent Nos 5 to 10 and such other persons as be found involved and pass….= 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3 Dr. YLR, J W.P.No.10543 of 2026 Dated 22.04.2026 3. Mr. K.J.V.N. Pundareekakshudu, learned counsel for the petitioner, submits that even though the petitioner submitted representations dated 06.12.2025 and 05.12.2025, those representations/complaints were not registered as FIRs. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the respondent police conducted a preliminary enquiry on the two complaints/representations submitted by the petitioner under Section 173(3) of 8the BNSS9 and found that the nature of the allegations is civil in nature; therefore, the respondent police could not proceed further on the petitioner9s complaints. 5. Be that as it may, the petitioner has an alternative efficacious remedy by filing a private complaint before the learned jurisdictional Magistrate under Section 190 read with Section 200 of 8the Cr.P.C.,9/Section 210 read with Section 223 of 8the BNSS9. 6. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, requiring the petitioner to approach the learned jurisdictional Magistrate by way of filing an appropriate complaint under Section 190 read with Section 200 of 8the Cr.P.C.,9/Section 210 read with Section 223 of 8the BNSS9, if so advised. 7. With the above observations and directions, the Writ Petition is disposed of.
