By means of this application, the Petitioner seeks the following relief: “The Petitioner, therefore, humble prays this Hon’ble Court may graciously pleased to dispose of this case with a direction to opp. Party no.3 not allow the outsider of Baria-II AWC for the post of Anganwai worker rather the representation dated 18.07.2009 of the petitioner may be accepted and allow her to be an Anganwadi worker of AWC. Or, any other order/orders, direction/directions may be passed by this Hon’ble Court, in favour of the Petitioner.” 3. In course of hearing in the application, Mr. Ray, learned counsel for the Petitioner drew the attention of this Court to the interim order passed in Misc. Case No.11932 of 2009 arising out of W.P.(C) No.14081 of 2009 wherein the Coordinate Bench of this Court vide order dated 05.10.2009 passed the followed order: “xxx As an interim measure, no appointment to the post of Anganwadi Worker in in respect of Baria-II Anganwadi Centre in the district of Mayrbhanj shall be made without leave of the Collector, Mayurbhanj. Misc. Case is accordingly disposed of.” p. 2 4. Having regard to the age of the case and the question being one relating to the appointment of the Anganwadi, if the recruitment process has not been undertaken pursuant to the interim order passed by the Coordinate Bench as above stated, the Petitioner shall submit a representation before the Opposite Party No.3 afresh within a period of two weeks. In the event such representation is made, the Opposite Party No.3 shall consider the same in accordance with law within a period of one month and to communicate the result thereof two weeks thereafter. A free copy of this order be supplied to the learned counsel for the State for onward transmission to the authority concerned for compliance.
