PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Revision Case has been filed under Sections 438 and 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), seeking suspension of the operation of the docket order dated 18.09.2026 passed in Crl.M.P.No.145 of 2026 on the file of the learned Principal District and Sessions Judge, Visakhapatnam, in connection with Crime No.198 of 2025 of I Town Police Station, Visakhapatnam. 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. On perusal of the record, it is seen that the Petitioners, who are Accused Nos.1 and 2, have challenged the docket order dated 18.09.2026. In that order, one of the sureties produced by them was discharged by the learned Trial Court, as he expressed apprehension that the accused might abscond from the jurisdiction of the Court, particularly since another case was also registered against them. The surety sought discharge, and the learned Trial Court accepted his request, noting his unwillingness to continue. However, without affording an opportunity to the Petitioners to furnish fresh sureties, the learned Trial Court straightaway issued Non‑Bailable Warrants (NBWs) against them. 3 4. Having regard to the facts and circumstances of the case, the order dated 18.09.2026 passed in Crl.M.P.No.145 of 2026 by the learned Principal District and Sessions Judge, Visakhapatnam, is hereby modified, enabling the Petitioners to submit fresh sureties to the satisfaction of the learned Trial Court within one (01) week from the date of receipt of a copy of this order. 5. The Petitioners shall appear before the learned Trial Court on the next date of hearing, i.e., 16.10.2026, without fail. 6. Accordingly, the Criminal Revision Case is disposed of.
