Order No:-05 Dated:-16-01-2026
Heard the parties.
This Civil Miscellaneous Petition has been filed by the petitioner with the prayer for restoration of S.A. No.308 of 2019 to its original file which stood dismissed for non-compliance of the order dated
06.08.2024.
Learned counsel for the petitioner submits that S.A. No.308 of 2019 stood dismissed for non-compliance of the order dated 06.08.2024. It is next submitted that the appellant of S.A. No.308 of 2019 prayed for time and the prayer for time was allowed subject to deposit of Rs.1,000/- by the appellant with the Jharkhand State Legal Services Authority (JHALSA) within two weeks but the said deposit could not be made within the stipulated time, as the counsel for the appellant of S.A. No.308 of 2019 tried to contact the appellant but in spite of hectic efforts made by the learned counsel for the petitioner, the counsel could not contact the petitioner; which resulted in dismissal of the said S.A. No.308 of 2019 for non-compliance of the order dated 06.08.2024. It is further submitted that non-compliance of the order dated 06.08.2024 was neither deliberate nor intentional. It is then submitted that the petitioner is ready to make the said deposit. It is also submitted that the petitioner has very good grounds to agitate in the said S.A. No.308 of
2019 and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the S.A. No.308 of 2019 be restored to its original file.
Learned counsel appearing for the opposite party has not raised any serious objection.
Considering the aforesaid submission of the learned counsel for the petitioner, S.A. No.308 of 2019 is directed to be restored to its original file at the same stage at which it was before its dismissal.
Registry is directed to list S.A. No.308 of 2019 before the appropriate Bench after a week.
This Civil Miscellaneous Petition is disposed of accordingly.
