2. This Review Petition under Order 47 Rule 1 read with Order 47 Rule 4(2)(b) of the CPC has been filed by the applicant/petitioner seeking review of
Order dated 05.05.2025 passed by this Court in WPS No.995/2020 (Kuldeep Singh Thakur vs. State of Chhattisgarh & Ors.). In the aforesaid order, this Court has passed following order in para 12 & 13, which reads thus:-
“12. In view of the above discussion, I feel inclined to allow the instant petition. Consequently, Communication dated 18.4.2019 (Annexure-P/3) passed by respondent No.4, whereby the claim of the petitioner for compassionate appointment was rejected, is set aside/quashed. Respondent No.2/State is directed to direct Secretary, Water Resources Department, Govt. of Chhattisgarh to consider the case of the petitioner for grant of compassionate appointment in the light of Circular No.F 7-1/2011/1-3, Nava Raipur, Dated 06th October, 2023 and Instructions 2013. it is further
directed that the said exercise be completed within a period of 90 days from today.

Learned counsel for the State is also directed to follow the order of the Court.”

Learned Sr. counsel appearing for the applicant/petitioner submits that against order dated 05.05.2025 passed in WPS No995/2020, the applicant/petitioner has preferred writ appeal being WA No.465/2025, but the same has been dismissed as withdrawn with liberty to avail other alternative remedy available to it. Hence, this review petition has been filed by the applicant/petitioner.
4. Perusal of the order dated 05.05.2025 passed by this Court in above mentioned para 12 shows that respondent No.2/State therein was directed to direct the Secretary, Water Resources Department, Govt. of Chhattisgarh to consider the case of the petitioner therein (respondent No.1 herein) for grant
3 of compassionate appointment in the light of Circular No.F 7-1/2011/1-3, Nava Raipur Dated 06th October, 2023. It was further directed that said exercise be completed within a period of 90 days from the date of the order. Aforesaid specific observation does not show that any direction was issued to the applicant/petitioner herein i.e. Managing Director, Chhattisgarh Infrastructure Development Corporation (CIDC), rather direction was given to the respondent/State through the Secretary, General Administration Department to direct the Secretary, Water Resources Department, Govt. of Chhattisgarh for compliance of the order.

Learned counsel appearing for respondent No.1-Kuldeep Singh Thakur submits that State of Chhattisgarh through the Secretary, Water Resources Department, State of Chhattisgarh through the Secretary, General Administration Department and the Collector, Janjgir, Distt. Janjgir Champa had also filed appeal against the order dated 05.5.2025 passed by this Court in WPS No.995/2020. That appeal has been rejected by the learned Division Bench vide Order dated 16.3.2026 passed in WA No.220/2026, on the ground of limitation. He further submits that since no direction was issued to the applicant/petitioner herein, i.e. Managing Director, CIDC, therefore, he has no locus to file this review petition. Hence, this review petition deserves to be rejected.

Having considered aforesaid facts and particularly considering the fact that vide Order dated 05.05.2025 passed in WPS No.995/2020, no direction was issued to the Managing Director, CIDC (applicant/petitioner herein), rather, the order was passed directing respondent No.2/State therein (Secretary, GAD), to direct Secretary, Water Resources Department, Govt. of Chhattisgarh to consider the case of the petitioner therein to grant compassionate appointment, therefore, the applicant/petitioner herein i.e.
4 Managing Director (CIDC) has no right to file review petition. Further appeal filed by the State through Secretary, Water Resources Department as well as GAD along with Collector, Janjgir Champa, challenging the order passed by this Court on 05.05.2025 has already been rejected vide Order dated 16.3.2026 passed by the learned Division Bench in WA No.220/2026.
7. Accordingly, the present review petition, being devoid of merit and not maintainable in law, stands rejected. Sd/- (Naresh Kumar Chandravanshi)
