The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with ARPAN SRIVASTAVA Digitally signed by ARPAN SRIVASTAVA Date: 2026.05.06 20:29:49 +0530 2 Crime No.609/2025, registered at Police Station- Telibandha District – Raipur (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of B.N.S. 2023. 2. That, the prosecution story in brief is that the Government of India has developed and is operating the “Samanvay Portal”, from where information was received that certain cyber fraud amounts have been deposited in multiple bank accounts maintained with UCO Bank, Raipur. On the basis of the said information, FIR was registered and during investigation it was found that the applicant had allegedly provided the bank account of his friend to the main accused for facilitating cyber fraud, in consideration of Rs. 50,000/-. Hence, the present bail application has been filed. 3. That, on the basis of the aforesaid grounds, it is submitted that the applicant is innocent and has been falsely implicated in the present case without any cogent or legally admissible evidence against him. That the applicant has neither derived any benefit from the alleged cyber fraud nor used his bank account or mobile number for any illegal activity. That there is no criminal antecedent against the applicant and he is in judicial custody since 21.12.2025. That the allegations are based merely on 3 memorandum statement without any corroboration. Hence, it is prayed that the applicant be enlarged on bail. 4. On the other hand, the learned State counsel opposes the bail application and submits that charge-sheet has been filed in the present case before the competent Court. He further submits that applicant has no previous criminal antecedent and in compliance with the Court order dated 08.04.2026, concerned Investigation Officer has filed his personal affidavit in the present case. 5. I have heard learned counsel for the parties and perused all of the documents available on record. 6. In compliance of the Court’s order dated 08.04.2026, the Investigating Officer of the subject crime number, Police Station Range Cybe, Raipur, District Raipur (C.G.) has filed his affidavit showing the incriminating evidence collected against the applicant during the course of investigation, relevant paragraphs of the affidavit are quoted here as under: “6. That in the memorandum statement before the concerned witnesses, the accused applicant has categorically stated and confessed to receiving the proceeds of crime in connivance with the other accused persons. It is further stated by the present accused 4 applicant that, he has sold his friend aforesaid bank account and registered mobile number to his colleague Umesh Harpal for Rs. 50,000/-. 7. That, during investigation, it was found that, in the aforesaid UCO Bank Account Number, the total amount of Rs. 17,58,620/- has been transacted from the date of its opening on 23.08.2024 within a short span of time period through cyber financial fraud/crime committed with the victim and a total amount of Rs. 17,58,378/- has been debited from the aforesaid bank account by the accused persons within short span of time period. 8. Taking into consideration the facts and circumstances of the case, and from the perusal of the case diary, it is prima facie evident that the applicant was actively involved in an organized cyber fraud racket by providing his bank accounts as mule accounts for laundering proceeds of cyber crime and during the investigation, it was found that, in the aforesaid UCO Bank Account Number, the total amount of Rs. 17,58,620/- has been transacted from the date of its opening on 23.08.2024 within a short span of time period through cyber financial fraud/crime committed with the victim and a total amount of Rs. 17,58,378/- has been debited from the aforesaid bank account by the accused persons within short span of time period. Thus, this Court is of the opinion that is not a fit case to grant regular bail to the applicant. 8. Accordingly, this bail application of application – Pulkit Kukreja, involved in Crime No.609/2025, registered at Police Station- Telibandha District – Raipur (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of B.N.S. 2023, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 6 10.
