---------- 03/21.04.2026 By way of present writ application, the petitioner has prayed for a direction upon the respondents to confirm his service which has not been done till date though petitioner has retired in the year 2024.
Further prayer has been made for direction upon the respondents to grant the benefits of 1st ACP who has completed 13 years of continuous service prior to his retirement.

Learned counsel for the petitioner submits that as per his instructions the respondents have started giving pension to the petitioner; however, the issue of 1st ACP has still not been redressed.

Learned counsel for the respondents submits that since no counter-affidavit has been filed, as such, petitioners may be directed to file fresh representation before the respondent-authorities so that his grievances can be addressed.

Having regard to the aforesaid facts and circumstances and limited submissions of the learned counsel for the parties, the instant writ application is hereby disposed of by directing the respondent No. 3 to treat this writ application as representation and take decision with regard to the claim made by the petitioner in accordance with law and applicable rules and regulations and also in view of the law

laid by the Hon’ble Apex Court in the case of Amresh Kumar Singh & Ors. Vs. State of Bihar & Ors.1, by passing a reasoned and speaking order within a period of 12 weeks from the date of receipt of a copy of this order. The petitioner is directed to serve a copy of this writ application to the concerned respondent so that his grievances can be redressed at the earliest.
5. If the decision is taken in favour of the petitioner, the consequential benefits shall be given to him within a further period of four weeks.
6. With the aforesaid observations and directions, the writ petition stands disposed of.
