Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioners have, inter alia, prayed for the following reliefs:- “A. That this Hon'ble Court may kindly be pleased to issue a writ of certiorari quashing and setting aside the final seniority list issued vide office memorandum dated 14.08.2023 (Annexure P-18). B. That this Hon'ble Court may kindly be pleased to issue a writ of mandamus, directing the respondents to decide representation dated 06.08.2021 and 3.9.2021 (Annexure P-14). C. That this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the respondents to decide the objections filed to the tentative seniority list (Annexure P-17). D. That this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the respondents to promote the petitioners to the post of Assistant Engineer (Civil) 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:19966 w.e.f. May, 2013 and June 2011.” 2. During the pendency of this petition, an Office Order has been issued on 19.05.2026, in terms whereof, the petitioners have been promoted against the post of Assistant Engineer (Civil) on notional basis w.e.f. 04.05.2016. 3. Learned Senior Counsel for the petitioners submits that in light of above development, this petition can be closed, but with liberty to the petitioners to approach the Court afresh, with regard to their surviving grievance of conferment of promotion from the month of May 2013/June 2011, respectively. 4. In light of subsequent developments, this petition is disposed of with the observation that the petitioners are given liberty to approach the Court afresh, if so advised, qua the relief of having been conferred promotion against the post of Assistant Engineer with retrospective effect from the month of May 2013/June 2011, respectively, as prayed for. It goes without saying that as far as the implementation of Office Order dated 19.05.2026 is concerned, the same be done expeditiously and preferably within a period of eight weeks from today.
