2. In this writ petition, the petitioner has prayed for following relief(s):-
“For quashing the entire certificate proceeding including issuance of arrest of warrant and attachment of property subsequently vide order dated 2.2.2011, 29.8.2017, 5.12.2017, 27.8.2018, 19.11.2019, 20.5.2020, 7.4.2021, 19.7.2024 and 18.9.2024 (Annexure 2 series ) issued in Certificate Case No. 08/2010-11 by respondent No. 5 whereby, he has issued notice to the petitioner under Section 7 of the Bihar and Orissa Public Demand Recovery Act, 1914 to the petitioner for recovery of Rs.59,780/- and subsequently increased amount of Rs. 1,61,661/-. It has also been prayed that during the pendency of the writ petition, the entire certificate proceeding including issuance of warrant of attachment and subsequent orders issued in Certificate Case No. 8/2010-11 may be kept in abeyance till the final disposal of the writ petition.”
3. During the course of arguments, learned counsel for the petitioner submits that he has not appeared before the Certificate Officer nor he has filed any application under Section 9 of the Bihar and Orissa Public Demand and Recovery Act, 1914 denying the liability.

4. Since the petitioner has not appeared before the Certificate Officer nor the Certificate Proceeding which was initiated against him has been stayed nor the petitioner has filed any application, it was well within the jurisdiction of respondents to take coercive steps against the petitioner.
5. Since the counsel for the petitioner submits that the Certificate proceeding is still pending against the petitioner, I direct the petitioner to appear before the Certificate Officer and file an application under Section 9 of the Bihar and Orissa Public Demand and Recovery Act, 1914 denying the liability. It will be open to the petitioner to file an appropriate application praying therein to recall the order by which coercive steps has been taken against the petitioner. If such application is filed, the same will be considered on its own merit and appropriate order will be passed by the Certificate Officer.
6. With the aforesaid observation and direction, this writ petition stands
disposed of.
