The petitioner seeks corpus of his minor daughter, who has been illegally detained by the respondent no.4. On the previous date, on behalf of the State, a statement was given that in this matter, an FIR bearing FIR No.93 of 2026, has been registered at Police Station Gaighat, District Muzaffarnagar, Bihar, and the victim is yet to be traced. Heard learned counsel for the parties and perused the record. Today, learned State Counsel submits that the daughter of the petitioner is not traceable. Learned State Counsel submits that FIR with regard to the missing of the corpus has already been lodged at Police Station Police Station Gaighat, District Muzaffarnagar, Bihar, under Sections 363 and 366 IPC, and the police is attempting to recover abducted Sushita, and for the arrest of the accused, but they are not traceable. Since the FIR has already been lodged, the matter is under investigation, and the accused in the FIR as well as the corpus is not traceable, at this stage, there seems to be no reason to keep this habeas corpus petition pending.
