The petitioner is an accused in connection with Sonari PS Case No. 100/2025. It has been alleged that the petitioner who is aged 72 years had established physical relationship with the minor daughter of the informant aged 12 years. Medical report indicates that an old torn was found in the hymen. Learned counsel for the petitioner submits that the petitioner has been falsely implicated as the informant has a habit of filing false cases against the persons of the neighbourhood including the petitioner. Learned counsel submits that the petitioner is in custody since 12.08.2025 and considering his age, his prayer for bail be considered. The learned A.P.P. has opposed the prayer for bail of the petitioner and has submitted that there are 10 charge-sheeted witnesses, out of which 5 witnesses have already been examined. Regard being had to the nature of offence and the involvement of the petitioner in committing such heinous offence, I am not inclined to grant bail to the petitioner and the same is hereby rejected.
