Minutes, only in respect of the petitioner for appointment by transfer to the post of Assistant Audit Officer for the panel year 2017-2018, though the petitioner's name was shown at Sl.No.10 as per the approved D.P.C. Minutes and implementing the said minutes in respect of SI.Nos.1 to 9 and granting promotion from 19-02-2018 and implementing the same D.P.C. Minutes to the petitioner from 07.09.2018, in spite of availability of vacancies for the panel year 2017-2018 and in spite of availability of retirement vacancy, arose in the month of April, 2018 due to the retirement of Sri B.D.D.Gnana Prakasam and not rectifying the injustice done to the petitioner, in spite of making representation dated 03.03.2026 as illegal, arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India and consequently declare that the Petitioner is entitled for notional promotion and seniority on par with his Batchmates, based on the DPC Minutes approved by the Respondents for effecting promotion to his Batchmates with effect from 19-02-2018 duly re-fixing the seniority in the cadre of Assistant Audit Officer immediately after Ch. This Writ Petition is filed to declare the inaction of the respondents for non-consideration the representation made by the petitioner on 03.03.2026. 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Finance for the respondents. 3. The learned counsel for the petitioner submitted that the petitioner was placed at Sl.No.10 in Zone–IV, and promotions were issued to Sl.Nos.1 to 9 on 19.02.2018 based on the recommendations of the D.P.C. Minutes, whereas the petitioner’s case was not considered at that time. Subsequently, he was promoted after a lapse of seven (07) months. It is further submitted that the delay was purely due to administrative reasons, and for no fault of the petitioner, for that he was penalized in terms of seniority and promotion to the post of Assistant Audit Officer. 4. Accordingly, without going into the merits of the case the writ petition is disposed of, directing the respondents to consider the representation made by the petitioner on 03.03.2026 and pass appropriate orders based on the record within a period of two (02) months from the date of receipt of copy of this order. There shall be no order as to costs.
