1. This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No.212/2025 registered at Police Station – Jutemill, District – Raigarh (C.G.) for the offence punishable under Sections 20(b) and 29 of NDPS Act and Section 111 of BNS.
2. As per prosecution story, in brief, is that on the basis of information received from informer, Sub-Inspector Girdhari Saav of Police Station Jutemill conducted a raid on dated VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.05.01 11:08:48 +0530
2 10.06.2025 in the jurisdiction of village Jutemill, District Badmal, Police Station Raigarh and seized 40 packets of ganja weighing approximately 40.172kg in a Swift Car number OR-17-G-4546 and 63 packets of ganja weighing approximately 64.818kg in a Grand Vitara Car number CG- 13-BB-9200 from the possession of the applicants/accused and other accused while being illegally transported for the purpose of sale. The Crime No. 212/2025 was registered under section 20(b) NDPS Act and the case was taken up for investigation. The accused were arrested, their memorandum statement recorded and one Swift Car number was CG-13- BB-9200 and four mobile phones of Vivo Company were seized and after investigation in the case, charge sheet has been presented.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and he is in jail since 11.06.2025. He would further submits that the mandatory provisions with regard to search and seizure were not complied with in this case and the conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicant on regular bail.
4. Learned State counsel, appearing for the State/non-applicant would oppose the bail application and submit that the police has seized 40 packets of ganja weighing approximately 40.172 kgs in a Swift Car number OR-17-G-4546 and 63 packets of ganja weighing approximately 64.818kg in a
3 Grand Vitara Car number CG-13-BB-9200 from the joint possession of the applicants/accused and other accused while being illegally transported for the purpose of sale and she further submits that bail application of co-accused namely, Virendra Singh @ Veer Singh was rejected by this Court in MCRC No.10511 of 2025 vide order dated 21.01.2026, therefore applicant is not entitled for grant of bail.
5. and the charge-sheet has been filed in the present case. As such, the present applicant is not entitled to be released on bail.
6. I have heard learned counsel appearing for the parties and perused the case diary.

Considering the facts and circumstances of the case, nature of offence and contraband article which is seized from the joint possession of the applicant and other co-accused i.e., 40.172 kgs and also considering the fact that bail application of co-accused namely, Virendra Singh @ Veer Singh was also rejected by this Court in MCRC No.10511 of 2025 vide order dated 21.01.2026, hence this Court is of the opinion that the present case is not fit for grant of bail and, accordingly, the bail application filed by the applicant is hereby Rejected.
8. Accordingly, this bail application of applicant – Ravishankar Goutam, involved in Crime No.212/2025 registered at Police Station – Jutemill, District – Raigarh (C.G.) for the offence punishable under Sections 20(b) and 29 of NDPS Act and
4 Section 111 of BNS, is rejected at this stage.
9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
