JUSTICE M.NAGAPRASANNA - 3 - HC-KAR NC: 2026:KHC:22825 CRL.P No. 289 of 2025 ORAL ORDER The petitioners are before this Court calling in question the proceedings in Crime No.357 of 2024 of Avalahally Police Station, Bengaluru Rural District, pending before the ACJM Court, Bengaluru Rural District, registered for offences punishable under Sections 498, 323, 504 and 506 of IPC and Sections 3 an 4 of DP Act. 2. Heard Sri M R Manjunath, learned counsel appearing for the petitioners, Sri B N Jagadeesha, learned Additional SPP appearing for respondent No.1, Sri C R Raghavendra Reddy, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint memo. Terms of settlement reads as follows: "JOINT MEMO UNDER SECTION 359 of BHARATHIYA NAGARIK SURAKSHA SANHITHA R/W 528 OF BNSS-2023 1. We state that we are the Petitioners and respondent No.2 respectfully submits as follows. - 4 - HC-KAR NC: 2026:KHC:22825 CRL.P No. 289 of 2025 2. we state that the 2nd respondent filed complaint against the petitioners against alleged in the complaint that 1st petitioner is the legally wedded husband of Smt. Jyothi and their marriage was solemnized on 20/06/2022 as per the wishes of family members and well-wishers at Gowramma Ramaiah Kalyanamantapa, Gokula House, Gokula, M.S. Ramaiah Road, Bangalore The 2nd petitioner is the mother of the 1st petitioner, 3rd petitioner is Father of 1st petitioner, 4th petitioner is younger brother of 1st Petitioner. We state that the 1st petitioner and 2nd respondent were staying in the above address mentioned in the cause title of 1st petitioner at the initial stage of the marriage was very caring towards her matrimonial home all were happy together subsequently she made allegation against this petitioners that her parents spent sum of Rs. 30 Lakhs towards her marriage and paid sum of Rs.5 Lakh as dowry also gold and silver ornaments she stayed with petitioners for short period at the house of petitioners No.2-4 further she made allegations the petitioners harassed her physically and mentally by demanding more dowry from her parents when she shifted her house to K.R. Puram there also the petitioners harassed her without providing food, clothes and household materials and not paying rent and use to ask money from her when the 2nd petitioner visit her house assaulted her and harassed her and abused her with filthy language mercilessly later her mother paid sum of Rs.3.Lakh in the month of April 2024 and threatened her with dare consequences hence she requested respondent police to take action against them based on the said complaint the 1st respondent registered a case against the petitioners in FIR No.357/2024 for an offences punishable U/s sections 498,323, 504,506 of Indian Penal Code and Section 3 and 4 of Dowry Prohibition Act, the petitioners have filed this petition for quashing the FIR No.357/2024 for an offences punishable U/s sections 498, 323, 504,506 of Indian Penal Code and Section 3 and 4 of Dowry Prohibition Act pending on the file of ACJM Court Bangalore Rural district, Bangalore 3. we submits that the 2nd respondent lodged complaint against the petitioners with misconception of facts, The 1st petitioner filed MC.No.6029/2024 against - 5 - HC-KAR NC: 2026:KHC:22825 CRL.P No. 289 of 2025 the 2nd respondent before the IV Addl. Family Judge, Bangalore under section 13(1)a, of Hindu Marriage Act same was settled amicably between the 1st petitioner and 2nd respondent before the Mediation center on 17/04/2026 subject to 1st petitioner pay sum of Rs.12,00,000/-(Twelve Lakh Only) to 2nd Respondent as permanent alimony out of Rs.12,00,000/- the 1st petitioner agreed to paid Sum of Rs.4,00,000/- to 2nd petitioner by way Cash and balance sum of Rs.8,00,000/-(Eight Lakh only) Paid drawn on Indian and exchanged entered in to by way of DD.No.316603 dated 15/04/2026 Overseas bank Kuppam Branch, Andra Pradesh their belongings, hence the 2nd respondent entered into compromise before the elders of the family and well-wishers not to proceed the criminal case each other with free will and consent and there was no force or threat each other in their personal life and they agreed they will not interfere with each other. 4. we submits that in terms of the settlement arrived between the parties the respondent No.2 has agreed to quash the proceedings pending in FIR No.357/2024 for an offences punishable U/s sections 498,323, 504,506 of Indian Penal Code and Section 3 and 4 of Dowry Prohibition Act pending before the Addl.C.JM Bangalore. 5. we submits that there has been no collusion or force fraud or any undue influence entering into this compromise in the afforsaid manner similarly both the parties have no future claims each other. 6. we submits that the parties have affixed their signatures with their free consent without having any misrepresentation, fraud and undue influence. Wherefore we prayed before this Hon'ble court be pleased to quash the further proceedings in FIR No.357/2024 for an offences punishable U/s sections 498,323, 504,506 of Indian Penal Code and Section 3 and 4 of Dowry Prohibition Act pending before the Addl.CJM Bangalore against the petitioners in the ends of justice. - 6 - HC-KAR NC: 2026:KHC:22825 CRL.P No. 289 of 2025 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the joint memo and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition stands disposed. ii. Proceedings pending in Crime No.357 of 2024 of Avalahally Police Station, Bengaluru Rural District, pending before the ACJM Court, Bengaluru Rural District, against the petitioners stands quashed.
