Agarwal, Advocate ---- 2/21.04.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Rajnagar P.S. Case No.49 of 2025, for the alleged offences registered under Sections 316(2), 316(3), 316(5), 318(4), 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M. 1st Class, Seraikella. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be the owner of the vehicle and the allegations are made that inferior quality of coal was supplied to the informant’s company. He further submits that the vehicle in question was booked by the transport agency and the petitioner has got no role in supplying of the low- quality coal. He then submits that other owners of different vehicles have been granted anticipatory bai in ABA Nos.6752 of 2026:JHHC:11705 2 2025, 5353 of 2025 and ABA No.6992 of 2025. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioner of supplying inferior quality of coal. 5. Considering that the agreement for supply of coal was between Rungta Mines Ltd. and Rajnandini Transport and the petitioner is said to be owner of the truck which has been hired by the said transporter and in identical situation owners of other vehicles have been granted anticipatory bail in the aforesaid ABAs, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Seraikella in connection with Rajnagar P.S. Case No.49 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. ( Sanjay Kumar Dwivedi, J.) 21.04.2026 SI/
