Petitioner has filed this petition under Article 226 of the Constitution of India with following reliefs: 2 “RELIEF SOUGHT: 10.1 That, this Hon'ble Court kindly be pleased to call the entire records pertaining to the case of the petitioner. 10.2 That, this Hon'ble Court kindly be pleased to issue appropriate writ/order/direction to the respondent authority to quash/ set aside the impugned order dated 09-03-2026 (Annexure P- 1) along with the subsequent letter/order dated 08-04-2026 (Annexure P-2) both issued by the Joint Director and Hospital Superintendent and President, Housing Allotnent Committee, Bharat Ratna Lt. Shri Atal Bihari Vajpai Smriti Medical College, District Rajnandgaon (C.G.), in the larger interest of justice. 10.3 That, this this Hon'ble Court kindly be pleased to issue appropriate writ/order/direction to the respondent authority to consider the complaint/application dated 17-02-2025 (Annexure P-5) submitted by the petitioner and take appropriate action on the same in accordance with law, in the interest of justice. 10.4 That, this Hon'ble Court kindly be pleased to issue appropriate writ/order/direction to the respondent authority to pay the compensation for physical and mental agony caused by the respondent authority, in the interest of justice. 10.5 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner together with cost of the petition.” 3 2. Relevant facts for disposal of this petition are that the petitioner was appointed as compassionate basis on 29-03-2016 on the post of ‘Lab Attendant’ in the Bharat Ratna Lt. Shri Atal Bihari Vajpai Smriti Medical College, District Rajnandgaon (C.G.) and on 30-11- 2021, he has been allotted a quarter/house bearing No.69, Block No.03, Atal Vihar Colony, Ward No.20, Pendri, District Rajnandgaon (C.G.), where he is residing alongwith his family members till date, however, vide impugned order allotment of his quarter/house No.69, Block No.03 has been cancelled/modified and a new house has been allotted to him which is Block No.2, F/F (38). Hence, this petition. 3. Learned counsel for the petitioner submits that petitioner is assailing the order, by which, he has been allotted a new quarter/house Block No.2, F/F (38), while directing to vacate the previous quarter which has been allotted to him, ie, quarter/house bearing No.69, Block No.03. Learned Counsel contended that without assigning any proper reason and without affording any opportunity of hearing, the petitioner has been allotted a new quarter which is not in accordance with law. Hence, petitioner came-up before this Court with aforesaid prayer/reliefs. 4. Learned State Counsel opposes the submissions of counsel for the petitioner and submit that there are some dispute between the petitioner and his neighbors for which several complaints has been made against the petitioner, as such, order has been passed 4 allotting the petitioner a new house/quarter. 5. Heard learned counsel for the parties and perused the writ petition. 6. Considering facts of the case, nature of dispute/reliefs, submissions of counsel for the parties, particularly the fact that vide impugned order only petitioner’s quarter/house has been changed and no any adverse order has been passed against him, therefore, this Court of the considered view that the contention/prayer as raised by the petitioner cannot be sustained in the eyes of law. 7. Accordingly, the impugned order is hereby affirmed/confirmed. Petitioner may vacate the said quarter/house within an stipulated time in accordance with law. 8.
