No. 1 of 2023 in W.P.No.29730 of 2023 dated 17-11-2023 passed by this Honble Court under section 10 to 12 of Contempt of Courts Act and grant Counsel for the Petitioners: KAVITHA GOTTIPATI Counsel for the Respondents: G V L MURTHY The Court made the following order: 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI C.C. NO: 2572 of 2026 O R D E R 1) This Contempt Case is filed alleging violation of the Order, dated 17.11.2023, which reads as under: “In the meantime, if the Respondent Authorities are taking up the exercise of Regularization, it is needless to state that the Seniors will be considered ahead of the Juniors”. 2) The averments in the affidavit shows that 2nd Respondent has acted upon taking steps and called for the details of eligible candidates of Contract Junior Lecturers to regularize their services in terms of Act 30 of 2023. This action of Respondents is illegal, arbitrary and nothing but flouting the Order passed by this Court on 17.11.2023 in W.P.No.29730 of 2023. Respondents have acted upon contrary to the Order of this Court vide Memo, dated 03.07.2026. Hence, Contempt Case is filed. 3) The Order speaks only to observe the seniority while taking up the regularization exercise and seniors must be considered ahead of juniors. It is not the case of Petitioner that any of the juniors were promoted ignoring the seniority either of Petitioner or any of the seniors. 4 4) Learned Counsel for Respondents have submitted written instructions stating that, as on date, no exercise of regularization is being undertaken by Respondent Authorities, as such, there is no occasion for him to implement the aforesaid direction regarding consideration of seniors ahead of juniors. 5) In view of the above, I do not see any violation of the Order of this Court passed on 17.11.2023. Hence, the Contempt Case is closed. 6) No order as to costs.
