1. By way of filing the instant criminal misc. petition, a prayer has been made for issuing directions to the Investigating Officer for conducting fair and impartial investigation of the FIR No.298/2024, registered with the Police Station Jurhara, District Deeg for the offences punishable under Sections 325 and 351(3) BNS. 2. It has been averred in the instant petition that for the incident dated 02/03.08.2024, the aforesaid FIR was registered with Police Station Jurhara, District Deeg on 23.08.2024, but in- spite of passing of considerable time, till date the matter has not been investigated in a fair and impartial way. Hence, the petitioner has approached this Court with the aforesaid prayer. [2026:RJ-JP:26592] (2 of 2) [CRLMP-7298/2024]
3. Per contra, learned Public Prosecutor opposed the prayer. 4. Heard and considered the submissions made at the Bar and perused the material available on the record. 5. Perusal of the record as well as the impugned FIR reveals that the FIR for the alleged offence was registered on 23.08.2024 and the petitioner has approached this Court on 21.10.2024 by way of filing the instant petition with the aforesaid prayer, even without approaching the authorities concerned for redressal of his grievances. 6. Considering the above overall facts and circumstances of the case, this Court deems it just and proper to dispose of the instant petition granting liberty to the petitioner to submit a representation before the Superintendent of Police, Deeg and Station House Officer, Police Station Jurhara, District Deeg for redressal of his grievances. 7. In case, such representation is submitted by the petitioner, it is expected from the concerned authorities to look into the matter and proceed with the matter in accordance with law, if the investigation is still lying pending. 8.
In case, report under Section 173 Cr.P.C. has already been submitted by the Investigating Agency before the Court concerned, this order will not have any effect. 9. With the aforesaid observations, the instant criminal misc. petition stands disposed of. The stay application as well as all pending applications, if any, stand disposed of.
