The present writ petition has been filed praying for quashing of the order dated 11.11.2024, whereby the Director, School Education, Uttarakhand has rejected the representation of the petitioner for financial upgradation under the MACP/ACP Scheme and for issuance of a writ of mandamus commanding the respondents to grant the petitioner financial upgradation to the next higher grade pay (Level 13 or equivalent in the pay matrix) w.e.f. the date he completed 10 years of continuous service in the same grade pay as Principal i.e. 25.10.2021 along with all consequential arrears and interest. 2. Learned counsel for the petitioner is not in a position to dispute that the petitioner can avail the appropriate reliefs from the Public Service Tribunal. 1 UKHC010141042026 2026:UHC:7026-DB 3. In view of it, we relegate the petitioner to the alternative remedy available before the Tribunal. 4. At this stage, learned counsel for the petitioner submits that the petitioner would file the claim petition before the Tribunal within one month and prays that direction be issued to the Tribunal to decide the same expeditiously. 5. Learned State Counsel has no objection to the same. 6. Accordingly, the writ petition is disposed of by providing that in case any claim petition is filed by the petitioner before the Public Service Tribunal within four weeks from today, the same shall be decided by the Tribunal expeditiously, without granting unnecessary adjournments to the parties.
