Learned senior counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and in the FIR itself, the informant has stated that the petitioner and informant were in relationship since six years prior to lodging of the FIR. He further submits that what has happened that was consensual in nature and according to him, even marriage has been solemnized and to buttress his argument, he refers to the marriage certificate issued under Section 13 of the Special Marriage Act, 1954 and according to him, the Notary Public was authorized to do the work of registration of marriage under the said Act. On these grounds, he submits that the anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State and informant have jointly opposed the prayer and submit that the allegations are there of establishing relationship on the pretext of marriage.
