GP FOR ENDOWMENTS The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.26186 OF 2026 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the inaction of the Respondent Nos.1 to 6 in not considering and disposing of the Petitioners' representation dated 19.12.2025 submitted seeking protection of the temple land belonging to Sri Malleswara Swamy Temple, Thummarakunta, situated in Survey No.1143, admeasuring Ac.5.36 cents, as illegal, arbitrary, unreasonable and violative of Articles 14 and 300-A of the Constitution of India, and consequently direct the Respondent Nos.1 to 6 to consider and dispose of the said representation dated 19.12.2025 by conducting necessary enquiry, examining the relevant Revenue, Endowments and Registration records, including Sale Deed Document Nos.1681 and 1682 and the proceedings/order in W.P.No.30128 of 2010 dated 28.02.2011, after affording reasonable opportunity to all the persons concerned, and pass a reasoned and speaking order within such time as may be stipulated by this Hon'ble Court and pass such other order or orders.…” 2. The inaction of respondent Nos.1 to 6 in protecting the land belonging to Sri Malleswara Swamy Temple, Thummarakunta, situated in Sy.No.1143, admeasuring Ac.5.36 cents, was questioned in the present writ petition, adverting to the fact that such inaction of the respondents’ amounts to violation of principles of natural justice. Consequently, prayed to direct the respondents to dispose of the representation dated 19.12.2025, after conducting necessary enquiry, examining the relevant Revenue, Endowments 4 and Registration records and affording a reasonable opportunity of hearing to all the affected parties. 3. Sri Bhagat Singh, learned Assistant Government Pleader for Revenue, furnished written instructions dated 10.09.2026, addressed by the Tahsildar, Peddathippasamudram, Annamayya District, to the learned Government Pleader for Revenue Office. It is asserted in the instructions that the respondent authorities have never recognized any third-party private claims over the Manyam land, rather, official records continue to stand in the name of the deity. It is further asserted that this Court may direct respondent Nos.4 to 6 to conclude the enquiry and pass formal speaking orders on the petitioners’ representation dated 19.12.2025. 4. Heard learned counsel for the petitioners and learned counsel for the respondents. 5. Learned Assistant Government Pleader appearing on behalf of the Endowment department submits that authorities are taking necessary steps to protect the land belonging to Sri Malleswara Swamy Temple, Thummarakunta. 6. Therefore, without adverting into merits of the case and in view of the admission made by learned counsel for respondents, the present Writ Petition is disposed of directing the respondent authorities to take necessary steps to protect the land admeasuring Ac.5.36 cents in Sy.No.1143, belonging to Sri 5 Malleswara Swamy Temple, Thummarakunta. There shall be no order as to costs.
