Heard learned counsel for the parties. 2. The present writ petition has been filed for the following reliefs :- “(a) for issuance of Writ in the nature of mandamus directing the Respondent Authorities to formally correct the entry of area in the Continuous Khatiyan [Annexure-5] from 9.59 Acres to 12 Acres as recorded in the name of Khiru Ram [Son of Late Latu Ram and father of Writ Petitioner-Govind Pandit) in respect to the Plot Nos. 1205 & 1206 [Corresponding to Old Plot No.1050] under Revisional Khata No.148 - 1 - W.P.(C) No.7866 of 2025 2026:JHHC:1917 [Old Khata No.216], Mouza- Telaiya, Thana No.244, Police Station-Telaiya, Post Office-Jhumri Telaiya, Block-Koderma, District-Hazaribag (now District- Koderma, Jharkhand), since a total Area of 20 Bighas (equivalent to 16 Acres) was initially purchased by Khiru Ram [Son of Late Latu Ram and the father of Writ Petitioner] by two Registered Sale Deeds, i.e., (i) vide Sale Deed dated 31.05.1958 Khiru Ram purchased from the Seller-Sri Tula Ram [Son of Damar Ram] an Area of 12 Bighas of Old Plot No.1050 [New Plot No.1205 & 1206] in Mauza-Telaiya, Pargana-Gumo, Thana- Koderma [Telaiya), Thana/Mouza No.244, under Khata No.216 and Revisional Khata No.148, Post Office-Jhumri Telaiya, Block- Koderma District-Hazaribagh and [now District -Koderma, Jharkhand] (ii) vide Sale Deed dated 31.05.1958 Khiru Ram purchased from the Seller-Sri Babu Lal Ram (Son of Tullo Ram) an Area of 8 Bighas of Old Plot No. 1050 [New Plot No. 1204, 1205 & 1206) in Mauza-Telaiya, Pargana-Gumo, Thana- Koderma [Telaiya], Thana/Mouza No.244, under Khata No.216 and Revisional Khata No. 148, Post Office-Jhumri Telaiya, Block-Koderma District-Hazaribagh [Now District -Koderma, Jharkhand] and thereafter (iii) Khiru Ram [Son of Late Latu Ram and father of Writ Petitioner -Govind Pandit] vide Sale Deed dated 08.01.1960 sold part of the aforesaid Land i.e., an Area of 5 Bighas [i.e. 4 Acres] of Plot No. 1204 [Old Plot No.1050] to (a) Sri Lekha Mistry [@Lekha Viswakarma] and (b) Kishun Mistry [@Kishun Viswakarma] & others, in Mauza-Telaiya, Pargana-Gumo, Thana -Koderma [Telaiya], Thana /Mouza No.244, under Old Khata No.216 and - 2 - W.P.(C) No.7866 of 2025 2026:JHHC:1917 Revisional Khata No.148, Post Office-Jhumri Telaiya, Block-Koderma, District -Hazaribagh [Now District-Koderma, Jharkhand], but during minor survey the Revenue Authority prepared the Purchaser's Raiyati Khatiyan and wrongly recorded therein an area of 4 Acres 38 Decimals instead of only 4 Acres. Thus an excess of 38 Decimals was wrongly recorded in the said Raiyati Khatiyan [Annexure-4], which also requires formal correction as per the Order dated 16-05-1968 passed in Suit No.1535 of 1967 by the then Revisional Authority, Hazaribag. (b) further the Petitioner prays for issuance of writ in the nature of Mandamus directing the Respondent Authorities to issue Rent Receipt in respect to left over lands for an area of 2.41 Acres [i.e., 2.03 + 0.38] for past years in favour of the Writ Petitioner [Son of Kheeru Ram] and issue Rent Receipts for the total area of 12 Acres [i.e., 9.59 + 2.03 + 0.38] for the current years.” 3. It has been submitted by the learned counsel for the petitioner that the petitioner possess the executable decree. 4. In that view of the matter, permission has been sought for by the learned counsel for the petitioner to withdraw the present writ petition with a liberty to get the decree executed through due process, in accordance with law. 5. Permission is accorded. 6. With the aforesaid liberty, the present writ petition stands disposed of. 7. Pending interlocutory application, if any, stands disposed of.
