Bordoloi, learned counsel for the applicant/claimant. Also heard Ms. RD Mozumdar, learned counsel for the opposite party/appellant Insurance Company. This is an application praying for a direction to the appellant to deposit 50% of the awarded amount in pursuant to the judgment dated 30.11.2025, passed in MAC Case 124(D)/2015. It is submitted by Mr. P. Bordoloi, the learned counsel for the applicant/claimant Page No.# 4/4 that due to delay in disbursing the awarded amount, the entire family of the claimant is suffering, who is living with her two minor children. Ms. RD Mozumdar, learned counsel for the opposite party/appellant vehemently raised objection and submitted that there is no such provision to direct the insurance company to deposit 50% of the awarded amount, as they have not prayed for stay of the impugned judgment dated 30.11.2025. In view of the fact that no order of stay has been passed by this Court, the present Interlocutory Application cannot be allowed by directing the opposite party/appellant Insurance Company to deposit 50% of the awarded amount in pursuant to the judgment dated 30.11.2025. However, considering the urgency of the case and the submission made by the learned counsel for both sides, the connected MAC Appeal No.654/2024 may be heard and decided on the next date of listing.
