been submitted that nothing has been recovered from the possession of the petitioner and the seizure list does not bear the signature of the petitioner. In this case, the charge has already been framed on 07.07.2025 and out of the six charge-sheeted witnesses no witness has been examined till date. Furthermore, the petitioner has no criminal antecedent. He is languishing in jail custody since 25.01.2025. 4. While on the other hand, learned APP has appeared and opposed the prayer for bail stating that there is direct and specific allegation against the petitioner that he killed his brother by assault with Rammer Tool (Dhurmus) and the bloodstained rammer tool used in the crime was recovered by the police on the basis of confessional statement made by the petitioner. 5. This Court has heard the learned counsel for the parties, gone into the imputation made in the FIR as also gone into the case diary. 6.
The allegation against the petitioner, as per the statement of the informant, is that on the issue of fencing of land, the petitioner attacked with the aid of Rammer Tool (Dhurmus) due to which the deceased sustained injuries and succumbed to death during treatment in the hospital. The tool used in the crime has also been recovered on the confessional statement of petitioner. 2026:JHHC:4875 Page | 3
Furthermore, the postmortem report also supports the prosecution version. It is a heinous crime in which allegedly assault is being made by the brother due to which he died. 7. This Court has taken into consideration the nature of crime which is heinous in nature, is of the view that the present application is not fit to be allowed. 8. Accordingly, the instant bail application stands rejected. (Sujit Narayan Prasad, J.) 18th February, 2026 Alankar/-
