By means of the present writ petition, the petitioner had challenge the order dated 10.07.2026, whereby, the petitioner was relieved to Government Girls Upper Primary School, Jainoli, Block Tarikhet, District Almora, (wrongly mentioned as Government Upper Primary School, Jainoli) by the Head Master of Government Primary School, Mangdoli, Block Tarikhet, District Almora. 4. Learned counsel for petitioner contends that Head Master of the Government Primary School, Mangdoli, has no power to relieve the petitioner. 5. The instructions were called from the State, and on the instructions, it is reflected that petitioner has been relieved under the order passed by Deputy Education Officer, Block Tarikhet, District Almora, dated 19.05.2026 for the reason that in Government Girls Upper Primary School, Jainoli, only one regular teacher is working against the students strength of 49 and therefore, the petitioner was directed to be UKHC010133562026 2026:UHC:7023 relived to the said Government Girls Upper Primary School, Jainoli, for Academic Session 2026-27 till further orders. 6. The learned counsel for petitioner vehemently argued that the Deputy Education Officer, Block Tarikhet, District Almora, does not have such power to direct the Head Master to relieve the petitioner. 7. I perused both the impugned order and the instruction carefully. Since, the Deputy Education Officer is immediate superior officer of the petitioner, therefore, in order to manage the affairs of the teaching in Primary Schools/Government Girls Upper Primary School, Deputy Education Officer, Block Tarikhet, District Almora has got power to passed such an order. The petitioner has been relieved only for Academic Session 2026-27 till further orders. 8. In such view of the matter, this Court finds no reason to intervene in the matter, therefore, the writ petition is accordingly dismissed. 9. However, it is provided that if the petitioner joins at the Government Girls Upper Primary School, Jainoli, Block Tarikhet, District Almora, within 07 days from today, he shall be paid entire arrears including the regular salary on month to month basis.
