2/05.05.2026 Heard learned counsels for petitioners and for State.
2.
The petitioners are apprehending their arrest in connection with Barhi PS Case No.441 of 2020, for offence registered under section 414/34 IPC, Section 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules and Rule 54 of Jharkhand Minor Mineral Concession Rules, pending in court of learned Sub Divisional Judicial Magistrate, Hazaribag.

Learned counsel for petitioners submits that the name of the petitioners has come on the basis of suspicion and the allegations are made that the petitioners were also involved in excavating the stones. He also submits that the petitioners are having one criminal antecedent which has been disclosed in

paragraph no.20 of the petition.
4. Learned State counsel opposes prayer and submits that name of the petitioners has come on the basis of suspicion.
5.
Considering that name of the portioners has come on the basis of suspicion and it has been pointed out that even at the place of occurrence no stones were found and further the criminal antecedent cannot be the sole criteria, either to reject or to allow the anticipatory bail or the regular bail, and in that view of the matter, I am inclined to grant anticipatory bail to both the petitioners.
6. Accordingly, both the petitioners, above named, are hereby
directed to surrender before learned court within two weeks from today, and in event of their surrender/arrest, the both petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Hazaribag, in connection with Barhi PS Case No.441 of 2020, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
