The grievance of the petitioner is directed towards Annexure-A, an order passed by the Karnataka Appellate Tribunal in the Revenue Appeal No.443/2025 filed by the petitioner, where the petitioner had also sought for interim prayers to stay the order passed by the Deputy Commissioner. Learned counsel submits that if the order passed by the Deputy Commissioner, which is under challenge before the Tribunal, is not stayed, the Revenue Authorities will proceed to evict the petitioner and make use of the property for some other purpose, which will defeat the appeal that is filed by the petitioner. - 3 - HC-KAR NC: 2026:KHC:14483 WP No. 7452 of 2026 3. In the considered opinion of this Court, whenever such an application for stay is filed in such matters, it would become incumbent upon the Court or Tribunal considering the interim application to pass an order of stay to ensure that the interest of the appellant before the Court/Tribunal is protected till the matter is disposed of finally. 4. Accordingly, the writ petition is allowed while setting aside the order dated 18.02.2026 passed by the Karnataka Appellate Tribunal in Revenue Appeal No.443/2026. Further, the interlocutory application filed by the petitioner/appellant before the Tribunal is allowed while staying the impugned order under challenge before the Tribunal till disposal of the appeal.
