2. The Petitioner has approached this Court for grant of regular bail in connection with Jama P.S. Case No. 46 of 2025, registered for the offence under Sections 303(2), 317(2) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of Judicial Magistrate First Class, Dumka.
3. Learned Sr. Counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is not named in the F.I.R. He further submits that the petitioner was neither arrested at the spot nor any incriminating article has been recovered from his possession. He further submits that the petitioner is languishing in custody since 17.08.2025; as such, the petitioner may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court.
4. Learned A.P.P opposes the prayer for bail of the petitioner and submits that there is direct and specific allegation against this petitioner; as such, he does not deserve grant of regular bail.
5. Having regard to the allegation made against this petitioner as well as gravity of the offence, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, his prayer for bail is rejected. However, the petitioner may renew his prayer for bail after 3 months.
