GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: <…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities in unduly obstructing and harassing the petitioner as illegal, arbitrary, violation of Article 19(1)(g) and Article 21 of the Constitution of India and also violation of Principles of Natural Justice, and consequently direct the respondents not to interfere with the petitioner's day-to-day business activities and not to harass the petitioner …= 2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader. 3. Mr. C. Nageswara Rao, learned Senior Counsel, appearing for Sri Amarendra Jillela, learned Counsel for the Petitioner, submits that the Petitioner is a valid license holder for transportation of livestock. However, his transportation activities have been unnecessarily obstructed by the Respondent Police, subjecting him to harassment, depriving him of his livelihood, and interfering with his day‑to‑day business activities. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that Respondent No.9 registered two cases against the Petitioner for allegedly violating certain norms and rules regarding transportation of livestock to the desired destinations. The Petitioner was 3 granted a license by the Directorate of Animal Husbandry, A.P., Vijayawada, vide Proc.Roc.No.AHFO2‑OPOMOEOFF(MISC)/12/2022‑AW(W)‑DAH dated 23.06.2022, to carry out transportation activities of livestock. 5. The Petitioner, in his affidavit, submits that on various occasions while transporting livestock, he was obstructed by the Respondent Police. Though cases were booked against him, when he was produced before the jurisdictional Magistrate along with the remand report, the learned Magistrate rejected the remand report. 6. The learned Assistant Government Pleader further submits that after registering the cases, the Respondent Police sent the livestock to shelter homes for care. He contends that the Petitioner carried out transportation activities without following the prescribed norms and rules, and therefore Respondent No.9 registered two cases against him. However, since the Petitioner holds a valid license for transportation of livestock, unless and until he violates any rules, regulations, or conditions stipulated under law, the Respondent Police are not empowered to obstruct transportation or subject the Petitioner to unnecessary harassment. 7. Considering the facts and circumstances of the case, and upon recording the submissions of the learned Senior Counsel for the Petitioner and the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Police not to henceforth obstruct or harass the Petitioner in the transportation of livestock. However, it is made clear that the 4 Respondent Police are empowered to interfere with such transportation if it is found to be contrary to the rules and regulations. 8. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y.
