Under the aforesaid objection letter, the first respondent directed the third respondent not to register any document in respect of the property morefully described in the affidavit filed in support of this writ petition, which according to the petitioner is owned by him. The objection letter dated 10.04.2024 has been issued since the petitioner’s vendor, one Vasu, is involved in a cheating offence. 3. Ms. Aswini Devi K, learned Additional Government Pleader accepts notice on behalf of the third respondent. Mr. V. Meganathan, learned Government Advocate (Crl. Side) accepts notice on behalf of the respondents 1 and 2. 4. The learned Government Advocate appearing for respondents 1 and 2 has placed on record an order dated 17.10.2025 passed under Section 107 of the BNSS read with Section 31(2) of the BUDS Act of the Special Court under the Tamil Nadu Protection of Interest of Depositors (in Financial Establishment) Act, 1997 in Crl. M.P. No. 505 of 2024 in Crime No. 03 of 2024. Under which the property which the petitioner claims to be the owner has been ordered to be attached, where the petitioner’s vendor Vasu is the accused. https://www.mhc.tn.gov.in/judis WP No. 8773 of 2026 5. A copy of the aforesaid order has also been given to the learned counsel for the petitioner. 6. Since the property has been ordered to be attached by the civil court, the question of entertaining this writ petition at this stage does not arise. Necessarily, the petitioner will have to seek for raising the order of attachment from the civil court and only if the order of attachment is raised, the third respondent will be in a position to register the documents pertaining to the property which the petitioner claims to be the owner. 7. For the foregoing reasons, this writ petition is disposed of by granting liberty to the petitioner to file appropriate proceedings before the competent court, seeking for raising of the order of attachment dated 17.10.2025 passed in Crl. M.P. No. 505 of 2024 in Crime No. 03 of 2024.
