The Appeal is directed against order dated 17.02.2024 passed by learned Commercial Court No.1, Jaipur, whereby application filed by respondent under order XXXIX Rule 1 and 2 for grant of interim injunction was allowed. 2. Before adverting to the merits of the case, we deem it appropriate to note the conduct of the appellant, as is borne out by the following orders passed by this Court from time to time, which are reproduced hereinbelow: "25/08/2025 1. No one has entered appearance on behalf of appellant. 2. Counsel for respondent states that despite undertaking recorded on 29th April 2025 given by counsel for appellant that a copy of the appeal shall be supplied during the course of the day, he has not been provided with the same. [2026:RJ-JP:27107-DB] (2 of 2) [CMA-1932/2024] 3. If a copy of appeal is not supplied before the end of this week, appeal will be dismissed on the next occasion with no exemption being granted. 4. Stand over to 13th October 2025. x-x-x-x-x 29/04/2025 Learned counsel for the appellant undertakes to supply copy of the appeal to the counsel for the respondent during the course of the day. Put up after six weeks. x-x-x-x-x 09/09/2024 Time is sought on behalf of the appellant. List after six weeks. In the meantime, appellant is directed to supply copy of memo of appeal to counsel for the respondent. x-x-x-x-x 08/08/2024 Counsel for the appellant is directed to supply a copy of the memo of appeal to counsel for the respondent who has put in appearance as a caveator. List this matter after four weeks. Name of Mr. Umang Gupta be shown in the cause list as counsel for the respondent(s)." 3. When the matter is taken up for hearing today, the position continues to be the same as above, as the appeal paper book has not been supplied to the learned counsel for the respondent. 4. On inquiry, learned counsel for the appellant appearing before us would submit that he will do the needful in due course. It so seems that the appellant is not interested in pursuing the appeal, and the same has been filed for the sake of keeping the matter pending. Even considering the conduct as noted hereinabove, we do not deem it fit to grant any further indulgence. 5. Accordingly appeal stands dismissed. 6. All pending application(s) also stand disposed of.
