This petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, namely, Raju Khan, has prayed for granting pre-arrest bail, apprehending arrest in connection with Nagaon P.S. Case No.898/2025, U/S 329(4)/64/115(2) of BNS, 2023. 3. Case diary is not received. Issue reminder for the same. 4. Call for the Nagaon P.S. Case No.897/2025, registered under Section 117(2)/308(2)/13(5) of BNS. 5. The learned counsel for the petitioner submits that the present has been filed as a counterblast to the FIR dated lodged from the side of the petitioner against several accused persons including the informant of the case lodged against the present petitioner. In the FIR lodged against the present petitioner, the allegation is about illicit relationship and exploiting the wife of the informant with some improper videos and pictures to blackmail her into physical relations. 6. On the other hand, the allegation in the FIR stated to have been lodged from the side of the petitioner is about assault of Raju Khan, the present petitioner. On the basis of the FIR lodged with regard to the alleged assault of the petitioner Raju Khan, Nagaon P.S. Case No. 897 of 2025 was registered and the FIR lodged against the present petitioner Raju Khan was registered into Nagaon P.S. Case No. 898 of 2025. 7. The petitioner was granted interim bail on 16.12.2025 and the case diary was called for. However, the learned Addl. P.P. submits that in the meantime, upon completion of investigation, the charge-sheet has been submitted vide charge-sheet No.10/2025 dated 06.01.2026. 8. In view of the completion of investigation, the interim bail granted vide Page No.# 3/3 order dated 16.12.2025 is hereby made absolute, subject to the condition that:- (i) He shall be available for the trial, if one commences, (ii) He shall not try to influence or intimidate to any witnesses. 9. In case of violation of the bail condition, the bail would be liable to be cancelled. 10. Accordingly, this anticipatory application stands allowed and disposed of. 11. Send back the case diary.
