JUSTICE SANGEETA SHARMA Order 15/07/2026 1. This instant bail application has been filed on behalf of the accused-petitioners against the orders dated 13.06.2026 passed by learned trial Court under Section 483 of BNSS in connection with FIR No. 46/2025 registered at Police Station Salempur, District Dausa for the offence(s) punishable under Sections 189(2), 109(1), 140(3), 111(2)(b) & 308(2) of BNS, in which [2026:RJ-JP:26924] (2 of 3) [CRLMB-10007/2026] charge-sheet has been submitted under Sections 189(2), 115(2), 126(2), 140(3), 110, 111(4) & 308(2) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have been falsely implicated in this case. He also submits that the accused-petitioners are in custody since long; that the charge-sheet has already been filed. He further submits that there are no criminal antecedents against the accused-petitioner Rinku. He further submits that injuries sustained by the injured are neither fatal nor dangerous to life; conclusion of trial will take its own time, so no fruitful purpose would be served by keeping the accused-petitioners behind the bars and, therefore, prays that the accused-petitioners may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor has vehemently opposed the contentions put forth by the learned counsel for the accused-petitioners and submits that there are four criminal antecedents against the accused-petitioner Phool Singh under Sections 379, 279 of IPC. 5. Considering the facts and circumstances of the case and rival contentions advanced by the learned counsel for both the parties and the material available on record in the form of charge-sheet; particularly keeping in view the fact that accused-petitioners are behind the bars since 02.05.2025; that there are no criminal antecedents against the accused-petitioner Rinku; that injuries sustained by the injured are neither fatal nor dangerous to life; that trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the accused-petitioners on bail. [2026:RJ-JP:26924] (3 of 3) [CRLMB-10007/2026] 6.
