This writ petition is filed seeking a direction to the Court of III Additional Principal Judge, Family Court, Bengaluru (hereinafter referred to as the ‘Family Court’) to expeditiously dispose of interim maintenance application - I.A No.3 filed under Section 24 of the Hindu Marriage Act, 1955 in M.C.No.6956/2025 which is pending on its file. - 3 - HC-KAR NC: 2026:KHC:20880 WP No. 11389 of 2026 3. Learned counsel for the petitioner submits that petitioner is the wife of the respondent. The respondent filed M.C.No.6956/2025 seeking for dissolution of marriage. It is further submitted that the petitioner and respondent, along with their minor child, were residing in a rented house at Yagappa Layout, Bengaluru. However, in October 2025, the respondent left the premises and started residing with his parents and has failed to pay rent, electricity charges and other utilities. Consequently, the owner of the property is threatening to evict the petitioner due to the non-payment of rent. The petitioner is a homemaker with no independent source of income. Hence, she filed an application - I.A No.3 seeking interim maintenance. The petitioner has filed assets and liability but the respondent has not filed the same. Though the respondent has filed objections to the application, the Family Court has not passed any order on the application. Being aggrieved by the same, this writ petition is filed. - 4 - HC-KAR NC: 2026:KHC:20880 WP No. 11389 of 2026 4. Record discloses justification in the submission that is made by learned counsel for the petitioner. Therefore, this Court considers desirable to dispose of the writ petition and give directions. Hence, the following: ORDER (i) Writ petition is disposed of. (ii) The Court of III Additional Principal Judge, Family Court, Bengaluru is directed to take all steps for disposal of I.A No.3 filed by the petitioner in M.C.No.6956/2025 as expeditiously as possible. (iii) This Court is not issuing the notice to the respondent as no adverse orders are passed and disposed of the petition in the interest of both the parties. (iv) As the writ petition is disposed of without notice to respondent, Family Court is directed to serve copy of this order to respondent so as to give notice to - 5 - HC-KAR NC: 2026:KHC:20880 WP No. 11389 of 2026 respondent, about filing of this petition and its disposal.
