UKHC010149712026 2026:UHC:7528 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS WPCRL/1708/2026 Harshdeep Kaur and Another --Petitioners Versus State Of Uttarakhand and Others --Respondents Hon'ble Alok Mahra, J. Mr. Ankush Singhal, learned counsel for the petitioners. Mr. Prabhat Kandpal and Mr. Akshay Latwal, learned A.G.A. for the State of Uttarakhand. 2. Defects as pointed out by the Registry are cured in the Court itself and are, accordingly, overruled. 3. By means of the present Criminal Writ Petition, the petitioners have approached this Court seeking the following relief: “i. Issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 & 3 to provide adequate security to the petitioners and also to direct the respondent nos. 4 to 8 not to interfere in the life and liberty of the petitioners, in any way.” 4. Learned counsel for the petitioners submits that both the petitioners are major and have solemnized their marriage today at a Gurudwara. Learned counsel further submits that the petitioners apprehend threat to their life and personal liberty at the hands of respondent nos. 4 to 8. Accordingly, the petitioners seek appropriate directions for protection of their life and personal liberty. 5. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court is prima facie satisfied that the petitioners have made out a case for consideration of their grievance regarding protection of their life and personal liberty guaranteed under Article 21 of the Constitution of UKHC010149712026 2026:UHC:7528 India. The law laid down by the Hon’ble Supreme Court in Lata Singh v. State of U.P. and Another also recognizes that two major individuals are entitled to choose their partner and cannot be subjected to threats or harassment on account of such choice. 6. Accordingly, the Station House Officer, Police Station Bazpur, District Udham Singh Nagar, is directed to assess the threat perception, if any, to the life and personal liberty of the petitioners. In the event any genuine threat is found to exist, the concerned police authorities shall provide adequate protection to the petitioners strictly in accordance with law. The Station House Officer shall also summon respondent nos. 4 to 8, as well as any other person found to be interfering with or threatening the petitioners, and counsel them to maintain peace and refrain from taking the law into their own hands. 7. With the aforesaid directions, the present Criminal Writ Petition stands disposed of. (Alok Mahra, J.) 20-08-2026 SB
