Prayer in the writ petition is made for quashing the order dated 4.6.2011 passed by the District Land Acquisition Officer-cum- Competent Authority, Ramgarh in Land Acquisition Case no. 7 of 2009-10 contained in Annexure 5 to the writ petition rejecting the objection filed by the petitioner relating to payment of compensation with respect to the land measuring 66.05 acres out of plot nos. 1127, 1142, 1144, 1196 of khata nos. 8 and 9 situated at village Bankheta, P.O., P.S. and District Ramgarh which has been acquired by the Government for construction of lane road under the provisions of Land Acquisition Act. 3. Learned counsel for the petitioners submits that the petitioners have already made objection however without properly considering the materials on record and the relevant provisions of law the said objection has been rejected and Award has been prepared. He further submits that the land in question was acquired for the purpose of construction of 4/6 lane road in N.H. 33 from Ramgarh to Ranchi. 4. Learned counsel for the State submits that the petitioners ( 2026:JHHC:7695 ) 2 are having alternative remedy in the light of Section 3 H (4) of National Highways Act, 1956. 5. In view of above this writ petition is disposed of with liberty to the petitioners to avail alternative remedy under the National Highways Act, 1956. Pending I.A., if any, stands disposed of.
