THIS WRIT PETITION IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO QUASHING THE IMPUGNED NOTICE DATED 04-02-2026 ISSUED BY THE RESPONDENT IN PROCEEDING NO. VIDE ANNEXURE-G AND ETC.,
THIS PETITION, COMING ON FOR ORDERS THROUGH VIDEO CONFERENCING / PHYSICAL HEARING, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE M.I.ARUN
ORAL ORDER
On the allegation that the petitioners have encroached upon Government land, the respondent issued a notice dated 04.02.2026 (vide Annexure-G to the writ petition), calling upon the petitioners to show cause. In response to the said notice, the petitioners have submitted a reply, along with all necessary particulars, to the respondent. However, apprehending that the respondent may unjustly evict them from the property, the present writ petition is filed.

2. The case of the petitioners is that they have not encroached upon any Government property, as alleged. It is contended that they are in occupation of the property belonging to them. On this ground, they pray that the notice at Annexure-G be set aside and that appropriate directions be issued to the concerned respondent.
3. The
learned counsel appearing for the respondent, upon instructions, submits that what has been issued to the petitioners is only a show cause notice, to which the petitioners have already submitted a reply. He further submits that the respondent, being a State authority, is not biased against any person, much less the petitioners, and that it has no prejudice against them. He further submits that the reply submitted by the petitioners will be considered; a spot inspection will be conducted, if required, and only thereafter, if it is found that the petitioners have indeed encroached upon public property as alleged, appropriate action will be initiated in accordance with law to have the same removed.
