[2026:RJ-JP:25741] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 6295/2026 URN: CRLMB / 11308U / 2026 Rajesh Kumar Rewar S/o Late Shri Tejaram Rewar, Aged About 39 Years, R/o Rukhasar, P.S. Ratangarh, Churu, (Raj.) Presently Confined In Central Jail Jaipur. ----Accused-Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Akshay Sharma For Respondent(s) : Mr. Manvendra Singh Choudhary, PP HON'BLE MRS. JUSTICE SANGEETA SHARMA Order 09/07/2026 1. This instant bail application has been filed on behalf of the accused-petitioner against the order of learned trial Court dated 15.04.2026 under Section 483 of BNSS in connection with FIR No. 9/2025 registered at Police Station Special Police Station (SOG), District ATS and SOG for the offence(s) under Sections 420, 467, 468, 471 & 120B of IPC and Section 3, 4, 6, 2(f)(ii) & 10 of Rajasthan Public Examination (Measures To Prevent Unfair Means In Recruitment) Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case. He also submits that accused-petitioner is behind the bars since long; that charge-sheet has been filed. He further submits that alleged offences are triable by Magistrate; that co-accused persons have already been enlarged on bail; conclusion of trial may take [2026:RJ-JP:25741] (2 of 3) [CRLMB-6295/2026] considerable time, so no fruitful purpose would be served by keeping the accused-petitioner behind the bars and, therefore, prays that the accused-petitioner may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor has vehemently opposed the contentions put forth by the learned counsel for the accused-petitioner and submits that there is one another criminal antecedent of similar nature registered against the accused- petitioner. 4. Considering the facts and circumstances of the case and rival contentions advanced by the learned counsel for both the parties; material available on record in the form of charge-sheet; particularly keeping in view the fact that accused-petitioner is in custody since 03.04.2026; that charge-sheet has been filed; that co-accused persons Rakesh Kaswan, Shipla Vishnoi, Vibhishan, Ramlal Roj, Umesh Tanwar, Birbal Jakhar, Suresh, Sangeeta Vishnoi, Manoj Kumar, Rakesh Jhakhad and Omprakash have been enlarged on bail by the Co-ordinate Bench of this Court in S.B. Criminal Misc. Bail Application Nos. 9047/2025, 6147/2025, 6899/2025, 6900/2025, 5350/2025, 8686/2025, 8687/2025, 10157/2025, 595/2026, 15606/2025 and 15607/2025 respectively; that trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the accused-petitioner on bail. 5. Therefore, this instant bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Rajesh Kumar Rewar S/o Late Shri Tejaram Rewar is ordered to be [2026:RJ-JP:25741] (3 of 3) [CRLMB-6295/2026] released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 6. It is made clear that the accused-petitioner shall not involve himself in any offence(s) during currency of the bail. 7. In case of any breach of the aforementioned condition, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court. 8. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. 9. Office is directed to send a copy of this order to the concerned trial Court through e-mail/fax, for necessary compliance. (SANGEETA SHARMA),J 8/EKTA
