HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CM(M) 28/2026 CM(325/2026). MANZOOR AHMAD MIR AND ANOTHER. …Petitioner(s) Through: Mr. Muzaffar Hamid Bhat, Advocate Mr. Sameer Ahmad Rather, Advocate. VERSUS MOHAMMAD ASHRAF MIR AND OTHERS. …Respondent(s) Through: None. CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE. ORDER 09.02.2026 01. There is an ongoing civil suit titled “Manzoor Ahmad Mir and Anr Vs Mohammad Ashraf Mir and Ors” pending before the Court of Civil Judge (Sr. Division), Pattan, wherein it is submitted that interim directions have already been put in place. 02. Notwithstanding the same, it is alleged that by acts of omission and commission on the part of the defendants in said civil suit, the directions of the Civil Court are being over- reached and violated with impunity, thereby rendering the filing of the civil suit by the petitioners effectively a self- inflicted wound upon them as well as upon the property forming the subject matter of the suit. 03. Under these circumstances, the petitioners have invoked the supervisory jurisdiction of this Court seeking a host of reliefs. 12 Regular 04. This Court is not inclined to grant any indulgence at this state of the matter. However, the petition is disposed of with a direction to the Court of Civil Judge (Sr Division), Pattan to maintain the authority and dignity of its direction/s and order/s passed in the civil suit, so as not to leave it to the hands of the litigants to undermine the authority of a civil court engaged in the adjudication of a civil suit. 05. Disposed of. (RAHUL BHARTI) JUDGE SRINAGAR 09.02.2026 Bisma Jan.
