JUDGMENT : Devashis Baruah, J. Heard Ms. T. Sekmou Chang, the learned counsel appearing on behalf of the Petitioner and Mr. Ajungli, the learned Government Advocate appearing on behalf of the Respondents. 2. The Petitioner herein is aggrieved by the non- consideration of the Petitioner’s application in terms with the Office Memorandum dated 17.09.2015 and the Addendum dated 09.04.2019. 3. It is the case of the Petitioner that the Petitioner’s father Late Imtisang was appointed vide an office order dated 17.05.2010 on contract basis as Veterinary Field Assistant and posted in SPBC, Merangkong under the Establishment of the District Veterinary Office, Mokokchung, Nagaland. 4. Thereafter the Petitioner’s father was promoted to SVFA on 10.06.2022. In the meantime, the Petitioner’s father was regularized vide the order dated 03.05.2012 passed by the Additional Director, Directorate of Veterinary and Animal Husbandry, Nagaland. 5. The Petitioner’s father expired on 22.08.2025 leaving behind her mother and four sisters along with the Petitioner. The Petitioner thereupon submitted an application on 03.09.2025 seeking consideration for appointment on compassionate basis in terms with the Office Memorandum dated 17.09.2015 read with the Addendum dated 09.04.2019. The Petitioner’s application being not considered, the Petitioner therefore has approached this Court by filing the present writ petition on 14.10.2025. 6. This Court vide an order dated 16.10.2025 issued notice. Today, when the matter is being taken up, Mr. Ajungli, the learned Government Advocate who represents the State Respondents has placed an instruction dated 04.12.2025. The said instruction is kept on record and marked with the letter “X”. 7. A perusal of the said instruction, it is seen that the Petitioner upon submission of her application which has been received by the Respondent No.4 on 08.10.2025, was asked to submit the Succession Certificate, Aadhar and Non-Employment Certificate which the Petitioner is yet to submit. 8. Be that as it may the Petitioner is placed at Serial No. 11 in the waiting list in terms with the Office Memorandum dated 17.09.2015. It is also mentioned that the Petitioner would be entitled for appointment on compassionate basis in terms with the Office Memorandum dated 17.09.2015 when her turns come and she cannot be appointed on compassionate grounds without submission of the documents i.e. the Succession Certificate, Aadhar and Non-Employment Certificate. 9. The learned counsel appearing on behalf of the Petitioner submitted that the Petitioner would submit the documents. 10.

Taking into account the above, this Court therefore disposes of the instant writ petition with the following observations and directions: (i) The Respondent Authorities are directed to consider the case of the Petitioner in terms with the Office Memorandum dated 17.09.2015 read with the Addendum dated 09.04.2019 upon submission of the Succession Certificate, Aadhar and Non-Employment Certificate which are required in terms with the Office Memorandum dated 17.09.2015. (ii) It is further observed that the Petitioner’s entitlement will be strictly in terms with the Office Memorandum dated 17.09.2015 read with the Addendum dated 09.04.2019.
