(2026:JHHC:4757) 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 11224 of 2025 Md. Sajid @ Sajwa, aged about 50 years, son of Abdul Majid, resident of Ratan Myeeka Road, P.O. & P.S. - Pachamba, District - Giridih. … … Petitioner Versus The State of Jharkhand … … Opposite Party --- CORAM : SRI ANANDA SEN, J. --- For the Petitioner : Mr. Neeharika Mazumdar, Advocate For the State : Mrs. Lily Sahay, Advocate --- 03/18th February, 2026 1. This Bail Application under Section 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 has been filed to release the petitioner on regular bail in connection with Pachamba P.S. Case No. 73 of 2023, for the offences punishable under Sections 448, 354B, 376, 511, 323, 325, 307, 379, 504 and 34 of the Indian Penal Code, pending before the Court of learned Chief Judicial Magistrate, Giridih. 2. Heard the learned counsel for the petitioner and learned counsel for the State. Perused the materials available on record and also gone through the impugned order. 3. Learned counsel for the State opposes the prayer of the petitioner for grant of bail and submits that the petitioner has entered in the house of the petitioner and tried to outrage her modesty by tearing her apparels. Thereafter, other accused persons came and gave tangi blow on her head causing injury. It is further submitted that the petitioner has got six criminal antecedent. 4. The allegation against the petitioner is that the petitioner entered the house of the victim when she was alone and it is alleged that he had torned her salwar-suit and tried to ravish her but when she made a hue and cry, the other co-accused persons came and assaulted the victim with the intention to kill and one Md. Faran had assaulted her with the axe. (2026:JHHC:4757) 2 5. After going through the records, I find that the allegation of assault by an axe is not upon the petitioner although the allegation against the petitioner is that he tried to outrage the modesty of the informant. Further, it is an admitted case of the parties that there is a long standing dispute between both the parties. The petitioner is in custody since 30.10.2025 and the charge-sheet has already been submitted in this case. 6. Considering the aforesaid fact that the charge-sheet has already been submitted in this case, the custody of the petitioner i.e., 30.10.2025, there was a long enimity between the parties and there is case and counter case and the assault which was inflicted, is not attributable to the petitioner, I am inclined to allow this bail application of the petitioner. 7. Accordingly, this Bail application is allowed. The petitioner above named, is directed to be released on bail in connection with Pachamba P.S. Case No. 73 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Giridh, subject to the condition that one of the bailers should be a close relative of the petitioner, having sufficient landed property in his / her own name within the State of Jharkhand and also the petitioner should mark his attendance once in a month before Pachamba Police Station.
