Petitioner has filed this petition seeking indulgence of this Court for a writ of mandamus commanding respondent no.3 to constitute a medical board to examine father of petitioner and issue medical certificate in accordance with rules; it is also prayed to direct respondent no.2-Director, Secondary Education to consider the representation of petitioner dated 18.07.2026 (Annexure No.9) expeditiously. 4. In brief, case of petitioner is that petitioner is posted as Lecturer (History) in Govt. Inter College Puriya Dang, Block Kaljikhal, District Pauri Garhwal since the date of his appointment i.e. 01.09.2016. Father of petitioner had to undergo Angioplasty on 29.05.2025. Petitioner’s father lives in outskirts of District Haridwar with his aged wife (petitioner’s mother). Since there is no adult member in the family to look after petitioner’s father, petitioner moved an application to respondent no.2 to transfer him from Pauri Garhwal to any of colleges located in and around District Haridwar. On the said application, petitioner was directed to produce medical certificate of his father from Uttarakhand State Medical Board, and for that purpose, an order has been passed by Director on 27.07.2026. Petitioner, accordingly, made an application which was ultimately referred to the UKHC010147312026 2026:UHC:7467 concerned Chief Medical Officer to get the medical examination of his father done by the State Medical Board, but till date, according to petitioner, neither the Medical Board has been constituted nor any medical examination of his father was done despite the order dated 10.01.2025 passed by C.M.O., Dehradun intimating that the medical board would be constituted for medical examination of his father. 5. Petitioner is aggrieved by the inaction on the part of respondent no.3-Director General, Medical Health, Uttarakhand in constituting the medical board, and it is for this reason, the application moved by petitioner for transfer from District Pauri Garhwal to District Haridwar is not being processed. 6. In such view of the matter, present writ petition is finally disposed of. Respondent no.3 is directed to immediately constitute a State Medical Board and examine the father of petitioner and in turn issue medical certificate in accordance with rules/ law either to petitioner or his father. The said exercise be completed by respondent no.3 within two weeks from today. If the medical certificate is thereafter issued to petitioner or his father, on supply of such certificate to respondent no.2, the said respondent shall consider and decide the application of petitioner for transferring him to District Haridwar within a further period of four weeks from the date of receipt of medical certificate issued by State Medical Board.
