Petitioner is the husband who has been implicated in the present case as an accused. Learned advocate for appearing for the petitioner submits that the post-mortem report reflects that the cause of death was due to drowning. There are 46 witnesses cited by the prosecution out of which till date 10 witnesses have been examined. Petitioner is in custody from 25.09.2024. Learned advocate prays for bail on any stringent conditions. Learned advocate for the State opposes the prayer for bail and submits that some time will be required to take the trial to its logical conclusion. 36 more witnesses are required by the prosecution to examine which will take some time. Having considered the same and without entering into the merits of the case, I am inclined to
2 release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. As such, petitioner namely, Aman Mahata shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Sessions Judge, 1st Court, Jhargram. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial Court and shall not leave the jurisdiction of District of Jhargram without prior permission of the learned trial Court. Additionally, petitioner shall meet with the Officer-in- Charge/Inspector-in-Charge of Jhargram Police Station once in every ten days till further orders of this Court. Thus, CRM (M) 742 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
