3. By means of the present application, the applicant seeks anticipatory bail in connection with Case Crime/F.I.R. No. 286 of 2022, registered at Police Station Selaqui, District Dehradun, for the offences punishable under Sections 420, 467, 468, 471 and 120-B I.P.C.

Learned counsel for the applicant would submit that the F.I.R. has been filed by the complainant against the applicant and other co-accused persons with regard to execution of certain sale deed in favour of several persons; that, thereafter, the SIT was constituted for investigation of case and in respect of each sale deed, the separate F.I.R. was lodged in respective police stations. He would further submit that the applicant is innocent and has falsely been implicated; that, there is no evidence

2026:UHC:7129 against the applicant with regard to the allegations levelled in the F.I.R.; that, no offence has been committed by the applicant.
5. Learned State Counsel, on instructions, would submit that the investigation has been concluded and the Investigating Officer has already submitted the charge-sheet before the competent Court. However, despite ample opportunities, counter affidavit has not been filed by the State.

Learned counsel for the applicant would submit that the Coordinate Bench of this Court, vide interim order dated 06.08.2024, granted interim anticipatory bail to the applicant and pursuant thereto, the applicant has remained available to the Investigating Officer and has fully cooperated with the investigation. It is further submitted that the investigation now stands concluded, the charge-sheet has been filed, and no material has been brought on record to indicate that the custodial interrogation of the applicant is either necessary or required. It is, therefore, prayed that the interim anticipatory bail granted to the applicant be confirmed.
7. Having heard learned counsel for the parties, perused the material available on record, and considering the fact that the applicant has remained protected under the interim
order dated 06.08.2024, has duly cooperated with the investigation, the investigation has been completed, the charge-sheet has already been submitted before the competent Court,

2026:UHC:7129 and there is nothing on record to suggest that the custodial interrogation of the applicant is now required, this Court is of the opinion that the interim protection granted to the applicant deserves to be confirmed. No opinion is being expressed on the merits of the case.
8. Accordingly, the interim anticipatory bail granted to the applicant vide order dated 06.08.2024 is made absolute. The applicant shall continue to remain on anticipatory bail on the same terms and conditions as contained in the
order dated 06.08.2024, subject to compliance thereof and subject to any other condition(s), if imposed by the trial Court in accordance with law.
9. The anticipatory bail application is, accordingly, allowed.
10. Pending applications, if any, also stand disposed of.
