Jaseem --Applicant Versus State Of Uttarakhand --Respondent
Hon'ble Alok Mahra, J.
Ms. Sheetal Selwal, Advocate for the applicant.
2. Ms. Pushpa Bhatt, D.A.G. alongwith Mr. S.C. Dumka, A.G.A. for the State.
3. Ms. Khusboo Tiwari Sharma, Advocate for the complainant.
4. By means of the present application, the applicant seeks anticipatory bail in connection with FIR/Case Crime No. 106 of 2026, under Sections 318(4) and 338 of BNS, registered at Police Station Lalkua, District Nainital.
5.
Learned counsel for the applicant would submit that applicant has falsely been implicated in the case, as vague allegations have been levelled against him in the FIR without there being any specific date or the amount of money, which was transferred in the account of the applicant.
6. Per contra, learned State Counsel, on instructions, submits that money was transferred in the account of the applicant as well as of the co-accused and furthermore the
applicant is not cooperating with the investigation. It is also submitted that NBW have also been issued against the applicant. Thus, learned State Counsel vehemently opposed the present anticipatory bail application and submits that the present anticipatory bail application is liable to be dismissed.
7. Heard learned counsel for the parties and perused the record.
8. Having considered the
facts and circumstances of the case, this Court is of the view that there is no good ground to grant anticipatory bail to the applicant and the present anticipatory bail application deserves to be rejected.
9. Accordingly, the present anticipatory bail application is hereby rejected.
