JUSTICE SANGEETA SHARMA Order 16/07/2026 1. These instant bail applications have been filed against the orders of learned Trial Court dated 16.05.2026 and 24.06.2026 on behalf of the accused-petitioners under Section 483 of BNSS in connection with FIR No. 181/2026 registered at Police Station Amer, District Jaipur City (North) for the offence(s) punishable [2026:RJ-JP:27066] (2 of 3) [CRLMB-8045/2026] under Section 111(2)(b) of B.N.S., 2023 and Sections 3, 25(6) & 25(8) of Arms Act. 2. Learned counsel for the accused-petitioners submit that the accused-petitioners have been falsely implicated in this case; that the accused-petitioner is in custody since long and there is no past criminal history. They also submit that the investigation is complete and recovery has been made. They further submit that the charge-sheet is proposed to be filed; conclusion of trial will take its own time, so no fruitful purpose would be served by keeping the accused-petitioners behind the bars and, therefore, pray that the accused-petitioners may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the submissions advanced by learned counsel for the accused- petitioners hereinabove but concurs with the fact that there are no criminal antecedents registered against the accused-petitioners. 4. Heard and considered the submissions made at the Bar and perused the material available on record, the overall facts and circumstances of the case and the contentions put forth by learned counsel for both the parties; that the charge-sheet is proposed to be filed; that the accused-petitioner is in custody since 04.05.2026; that there are no criminal antecedents registered against the accused-petitioner; that recovery has already been made and the accused-petitioners are not required for further investigation; that the trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the accused- petitioners on bail. [2026:RJ-JP:27066] (3 of 3) [CRLMB-8045/2026] 5. It is made clear that the accused-petitioners shall not involve themselves in any offence(s) during currency of the bail. 7. In case of any breach of the aforementioned condition, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court. 8. The observation made hereinabove is only for decision of these instant bail applications and would not have any impact on the trial of the case in any manner. 9.
