2. An advertisement was issued by respondent no.3 for filling up the posts of Assistant Teacher, Primary School in District Uttarkashi. The petitioner, being fully eligible, applied for the said post. A provisional merit list was published, wherein the petitioner was shown to have secured 79.90 quality marks. As per the notification, counselling for document verification was scheduled to be held on 12.01.2026 at 11:00 a.m. in the office of respondent no.3.

Learned counsel for the petitioner submits that the petitioner had duly completed the D.El.Ed. course; however, the result thereof was declared on 09.07.2025 and the formal D.El.Ed. diploma certificate was issued only on
12.01.2026. When the petitioner appeared for counselling, she submitted a photocopy of the marksheet, duly attested by the concerned college, but the same was not accepted by the authorities. It is further submitted that the petitioner sought a short time of three days to submit the original D.El.Ed. certificate and marksheet, but her request was not considered.
4. Considering the
facts and circumstances of the case, it appears
2026:UHC:641 that the petitioner could not produce the original D.El.Ed. certificate on the date of counselling for reasons beyond her control, inasmuch as the certificate itself was issued on the same date, i.e., 12.01.2026, and was required to be collected from the concerned DIET at Moradabad and thereafter submitted at Uttarkashi. Denial of consideration in such circumstances would cause undue hardship to the petitioner.
5. Accordingly, in the interest of justice, the petitioner is granted one opportunity to produce the original D.El.Ed. certificate and relevant documents. The petitioner is directed to appear before respondent no.3 on 28.01.2026 along with the original D.El.Ed. certificate and marksheet at 11:00 a.m., whereupon respondent no.3 shall consider the petitioner’s candidature in accordance with law and, if found in order and eligible, her name shall be included in the further selection process as per her merit and Recruitment Rules.
6. The writ petition stands ordered accordingly.
