(2) Petitioner has challenged order dated 19.2.2022, passed by Executive officer, Nagar Palika Parishad, Pithoragarh. By the said order, petitioner’s request for allotment of shop was turned down and he was informed that as and when public notice is issued, as per provisions of Uttarakhand Procurement Rules, petitioner can apply for allotment of shop. (3) Learned Counsel for the petitioner submits that petitioner was given permission to construct a toilet and also to raise a shop next to the toilet, however both toilet and shop were demolished due to road widening. He submits that petitioner needs to be rehabilitated, as earlier also Nagar Palika had allotted him land for construction of shop and toilet. (4) This Court do not find any scope for interference with the impugned rejection order dated 19.2.2022. Nagar Palika as a public authority is bound by Procurement UKHC010152882022 2026:UHC:7482 Rules, therefore the statement contained in the rejection order that petitioner will have to apply for allotment whenever public notice is issued, cannot be faulted. (5) Writ petition is, accordingly, disposed of with liberty to petitioner to make application as and when public notice is issued. However, petitioner shall be at liberty to approach the competent court seeking compensation and if he files a suit, the same shall be heard and decided on merits.
